This End User License Agreement (“EULA”) is a legal agreement between you and Divine, operated by Tiger LLC (“Divine,” “we,” “us,” or “our”), for the Divine mobile application, including any updates, upgrades, documentation, and related app-store distributed materials (collectively, the “App”). By downloading, installing, accessing, or using the App, you agree to this EULA. If you do not agree, do not download, install, access, or use the App.
This EULA governs your license to the App. Your use of Divine’s voice, messaging, social, purchase, safety, account, and web services is also governed by our Terms of Service, Privacy Policy, Community Guidelines, and other policies linked from divineapp.io. If this EULA conflicts with the Terms of Service, this EULA controls only for the limited question of your license to install and use the App; the Terms of Service control for all other use of Divine.
1. Eligibility
Divine is intended only for adults who are at least eighteen (18) years old. By installing, accessing, or using the App, you represent that you are at least 18, have the legal capacity to enter into this EULA, and are not barred from using the App under applicable law or any prior enforcement action by Divine.
2. License grant
Subject to your compliance with this EULA and our Terms of Service, Divine grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices that you own or control, solely for your own lawful, personal use.
The App is licensed, not sold. Divine and its licensors reserve all rights in and to the App that are not expressly granted to you in this EULA, including all intellectual-property rights in the App, the Divine name, logos, design, features, code, content, and technology.
2.1 Apple App Store license scope
If you downloaded the App from the Apple App Store, your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Conditions, including the Usage Rules, Family Sharing, and volume-purchase rules that apply to your account.
2.2 Google Play license scope
If you downloaded the App from Google Play, your license is limited to installing and using the App on Android devices that you own or control and as permitted by the Google Play Terms of Service, Google Play policies, and any applicable device or carrier terms. To the extent Google Play’s developer-distribution terms supersede any part of this EULA, those terms will apply.
3. License restrictions
You agree that you will not, and will not help anyone else to:
- Copy, modify, translate, adapt, or create derivative works of the App except as expressly permitted by this EULA or applicable law.
- Rent, lease, lend, sell, sublicense, redistribute, publish, or otherwise transfer the App or your license to the App.
- Reverse engineer, decompile, disassemble, attempt to derive source code from, or bypass technical limitations in the App except to the limited extent applicable law prohibits this restriction.
- Use bots, scripts, scrapers, automation, emulators, or unauthorized clients to access Divine.
- Circumvent age gates, account limits, device checks, rate limits, payment controls, geographic restrictions, moderation tools, or security features.
- Use the App to violate any law, infringe any third-party right, or violate our Terms of Service or Community Guidelines.
- Use voice, image, message, or profile content from Divine to create deepfakes, synthetic voices, impersonation systems, surveillance datasets, or other deceptive or harmful systems.
- Remove, obscure, or alter any proprietary notices, labels, or marks in the App.
4. Your account and content
The App lets you create a profile, post content, send messages, speak in voice features, join communities, purchase virtual items, and use other social features. Your account, User Content, purchases, moderation, reports, and community conduct are governed by our Terms of Service and Community Guidelines. You retain ownership of content you submit, but you grant Divine the license described in the Terms of Service so we can operate, secure, moderate, and improve Divine.
Divine has zero tolerance for objectionable content and abusive users. Conduct involving child sexual exploitation, harassment, threats, hate speech, non-consensual intimate content, scams, impersonation, doxxing, unauthorized recording, or other prohibited conduct may result in content removal, suspension, permanent account termination, device-level enforcement, and reports to law enforcement where required or appropriate.
5. Purchases, subscriptions, coins, and gifts
The App may offer paid subscriptions, consumable coin packs, virtual gifts, boosts, or other in-app items. All purchases are processed by the applicable app store and are subject to that store’s billing, cancellation, refund, tax, and payment terms. Subscription renewal, cancellation timing, refunds, virtual coin rules, and gift rules are described in our Terms of Service.
Virtual coins, gifts, boosts, and other digital items are licensed features for use inside Divine. They have no cash value, are not bank deposits or stored-value accounts, cannot be sold or transferred outside Divine, and are non-refundable except as required by applicable law or the applicable app-store policy.
6. Updates and availability
We may update, patch, modify, suspend, or discontinue all or part of the App at any time. Updates may be required for continued use of Divine, security, compatibility, moderation, payment processing, or compliance with law. Depending on your device and app-store settings, updates may install automatically. We are not obligated to provide any particular feature, version, or availability level.
7. Maintenance and support
Divine is responsible for providing maintenance and support for the App as described in this EULA or required by applicable law. Apple and Google have no obligation to provide maintenance or support for the App. For support, email support@divineapp.io from the email address associated with your account when possible.
8. Privacy and device permissions
The App may request access to device capabilities such as camera, photos, microphone, push notifications, location, advertising identifiers, contacts-independent sign-in providers, and payment services, depending on the features you use. Our Privacy Policy, Cookie Policy, and Consumer Health Data Privacy Policy explain what we collect, why we collect it, how we share it, how long we retain it, and what privacy rights may apply to you.
9. Third-party services and terms
Divine integrates third-party services for app-store distribution, sign-in, payment processing, purchase validation, image hosting, real-time voice and video routing, push notifications, moderation, verification, analytics, diagnostics, and advertising. These services are operated by independent companies under their own terms and privacy notices.
You must comply with all applicable third-party terms when using the App, including the terms of your app store, device manufacturer, operating system, wireless carrier, internet provider, payment provider, and any connected sign-in provider. For voice, video, messaging, and live audio features, you are responsible for ensuring that your use complies with your wireless data, internet, recording, and communications-service agreements.
10. Intellectual property and product claims
Divine is responsible for addressing claims from you or third parties relating to the App or your possession and use of the App, including product-liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, consumer-protection claims, privacy claims, and intellectual-property infringement claims. Apple and Google are not responsible for investigating, defending, settling, or discharging any such claims.

11. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. DIVINE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.
If you downloaded the App from the Apple App Store and the App fails to conform to any applicable warranty that cannot lawfully be disclaimed, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple will have no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Divine’s responsibility to the extent required by applicable law.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVINE, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, DEVICE FAILURE, OR UNAUTHORIZED ACCESS, ARISING FROM OR RELATED TO THE APP OR THIS EULA.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVINE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP OR THIS EULA WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO DIVINE THROUGH THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in this EULA limits liability that cannot be limited under applicable law.
13. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Divine, its owners, officers, employees, contractors, affiliates, service providers, and licensors from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App, your breach of this EULA, your violation of law, your violation of third-party rights, or your User Content.
14. Termination
This EULA is effective until terminated. You may terminate it by deleting the App from your devices and stopping all use of Divine. We may terminate or suspend your license immediately if you breach this EULA, violate our Terms of Service or Community Guidelines, create risk for other users, create legal exposure, or if your account is suspended or terminated.
Upon termination, your right to use the App ends immediately and you must stop using and delete the App. Sections that by their nature should survive termination will survive, including ownership, restrictions, warranty disclaimers, limitation of liability, indemnification, dispute terms, and app-store-specific terms.
15. Export and sanctions compliance
You represent and warrant that you are not located in a country or region subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable U.S. and international export-control, sanctions, and trade laws.
16. U.S. government end users
The App is commercial computer software and commercial computer software documentation. If acquired by or on behalf of the U.S. government, the App is licensed only with the rights granted to all other end users under this EULA and as restricted by applicable federal acquisition regulations.
17. Governing law and disputes
Disputes arising from or related to this EULA are governed by the governing-law, arbitration, class-action waiver, opt-out, venue, and dispute-resolution provisions in our Terms of Service, except where applicable law requires otherwise. Nothing in this EULA limits any non-waivable consumer rights you may have under the laws of your place of residence.
18. Changes to this EULA
We may update this EULA from time to time. If a change is material, we will provide notice in the App, by email, through the applicable app store, or by updating this page. Your continued use of the App after the effective date of the revised EULA means you accept the revised EULA. If you do not agree, you must stop using and delete the App.
19. App-store-specific terms
19.1 Apple
If you downloaded the App from the Apple App Store, you and Divine acknowledge that this EULA is concluded between you and Divine only, and not with Apple. Divine, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
19.2 Google
If you downloaded the App from Google Play, you acknowledge that this EULA is between you and Divine only. Google is not responsible for, and has no liability under, this EULA. Your use of Google Play, Google Play billing, and Android platform services remains subject to Google’s applicable terms and policies.
20. Severability and assignment
If any provision of this EULA is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the parties’ intent. You may not assign or transfer this EULA or your rights under it without our prior written consent. We may assign this EULA in connection with a merger, acquisition, financing, corporate reorganization, or sale of assets.
