These Terms of Service (“Terms”) govern your access to and use of the Divine mobile application and any related web properties (collectively, the “Service”), operated by Tiger LLC (“Tiger LLC,” “we,” “us,” or “our”), a business entity located in California, United States. By accessing or using Divine you agree to these Terms. If you do not agree, you must not use the Service.
Divine is a voice-first social application. Some features described here (such as live audio Spaces, Clans, gifts, and Stories) may be unavailable in certain regions or rolled out gradually. Nothing in these Terms is intended to limit any rights you have under applicable consumer protection law.
1. Eligibility
You must be at least eighteen (18) years of age to create an account, access, or use Divine. By using the Service, you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms. We may, at any time, require additional proof of age (including but not limited to government-issued identification or biometric age estimation). If we have credible reason to believe you are under 18, we will suspend your account and delete associated data in accordance with our Child Safety policy.
2. Your account
When you register, you agree to:
- Provide accurate, current, and complete information and keep it up to date.
- Keep your sign-in credentials secure. We support sign-in with Apple, Google, and email — protect whichever method you use.
- Accept responsibility for all activity that occurs under your account.
- Notify us at support@divineapp.io if you suspect unauthorized access.
- Use only one account at a time. We may use Apple DeviceCheck or equivalent signals to detect and prevent the same device from being used to spawn additional accounts that evade enforcement.
We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, our Community Guidelines, applicable law, or that risks harm to other users.
3. Your content (“User Content”)
3.1 What counts as User Content
User Content includes everything you create, upload, post, share, transmit, or otherwise make available on Divine, including but not limited to: profile information, photos, voice messages, live audio you speak in Spaces, audio in a one-on-one voice or video call, posts, Stories, comments, replies, reactions, Clan messages, direct messages, and reports you submit about other users.
3.2 You keep ownership; you grant us a license
You retain ownership of your User Content. By submitting User Content to Divine you grant Tiger LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for example, to resize images for different layouts or transcode audio for delivery), publicly perform, publicly display, and distribute that User Content solely for the purpose of operating, providing, improving, promoting, and securing the Service. This license persists for as long as your content remains on the platform and for a reasonable period afterward to allow for removal from backups and content-delivery caches.
3.3 Your representations
You represent and warrant that:
- You own or have the necessary rights, licenses, and permissions to upload your User Content.
- Your User Content does not infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights.
- Your User Content complies with these Terms, our Community Guidelines, and all applicable law.
- You have the consent of every person who appears in or whose voice can be heard in any content you upload.
3.4 Pre-screening and moderation
We do not pre-screen most User Content but reserve the right to review, moderate, hide, or remove anything we believe violates these Terms, creates legal exposure, or harms other users. Images you upload are scanned for harmful content before they reach other users (see Section 8).
4. Feature-specific rules
4.1 Voice match
Voice match places you on a one-on-one audio call with another user who is also looking to talk. Either of you can leave at any time. By starting a voice match you agree that:
- You will not record, capture, or redistribute any voice call without the explicit consent of every participant. Unauthorized recording may violate federal and state wiretapping and eavesdropping laws.
- You will respect the other person’s decision to leave the call without explanation.
- Tiger LLC does not record voice match audio. We retain only call metadata (timestamps, duration, participant identifiers) for safety and operational purposes.
- Reports about behavior during a voice match are reviewed manually. We may interview both parties before taking action.
4.2 Spaces (live audio rooms)
Spaces are drop-in audio rooms hosted by other users. By participating you agree that:
- Hosts have the right to mute, remove, or block any participant for any reason.
- Speaking in a Space is a public broadcast within Divine — anyone in the room can hear you.
- You will not record, simulcast, or otherwise capture audio from a Space without explicit permission from the host.
- Hosts are responsible for moderating their own Spaces. Tiger LLC may also intervene if a Space violates these Terms.
4.3 Clans (small voice-and-text communities)
Clans are community spaces with their own members and rules. Clan administrators may set additional community rules consistent with these Terms and our Community Guidelines. We may close Clans that exist primarily to evade enforcement (e.g., to harass a user, to share prohibited content, or to coordinate harm).
4.4 Posts and Stories
Posts are persistent and visible to your followers and (depending on privacy settings) to discovery surfaces. Stories vanish from public view 24 hours after posting; the underlying file is removed from active storage on the next housekeeping pass. Deletion from backups follows the normal rotation described in our Privacy Policy.
4.5 Direct messages and voice messages
Messages exchanged in chat — including voice messages — are delivered through Divine but are not pre-screened. We may review messages in response to a report, a lawful request, or a clear safety concern. You must not use messaging to do anything prohibited under Section 5.
4.6 Gifts and coins
Divine offers virtual gifts that can be sent during voice match, in Spaces, on profiles, or in chat. Gifts are paid for using virtual coins purchased through the Apple App Store or Google Play Store. Coins are a consumable, non-transferable license to access an in-app feature. They:
- Have no cash value and cannot be exchanged for currency or refunded outside the policies of the applicable app store.
- Do not constitute a payment to the recipient and do not give either party any expectation of in-person interaction or service.
- May expire if your account is terminated for violations of these Terms.
4.7 Verification
Face verification is used to confirm an account belongs to a real human and not a photo or bot. You may be required to complete verification before some features unlock, and we reserve the right to require re-verification if we detect signs of automation, identity recycling, or suspicious activity.
5. Prohibited conduct
Divine has ZERO TOLERANCE for objectionable content and abusive users. Content or conduct that is sexually explicit involving minors, harassing, threatening, hateful, or otherwise objectionable will result in immediate removal and may result in permanent account termination and a device-level ban. Detailed rules of conduct live in our Community Guidelines. At a minimum, you agree not to use Divine to:
- Threaten, harass, stalk, bully, or coordinate harm against any person.
- Post hate speech, slurs, or content promoting violence against any protected group.
- Share sexual or sexually explicit content, including in your voice, photos, profile, or any User Content.
- Post, request, share, or solicit content that sexually exploits minors. This is a permanent, non-appealable ban and we report to NCMEC and law enforcement.
- Disclose another person’s private information (“doxxing”) or share intimate content of another person without their explicit consent.
- Engage in fraud, impersonation, catfishing, scams, phishing, romance scams, or financial extortion.
- Use Divine to advertise, sell, or solicit goods, services, or in-person meetings of a commercial or sexual nature.
- Record, extract, or redistribute voice content from Divine to create deepfakes, synthetic voice clones, or any manipulated audio intended to deceive, defraud, or impersonate.
- Use bots, scripts, scrapers, or automated tools to interact with the Service.
- Attempt to gain unauthorized access to any part of the Service, other users’ accounts, or supporting infrastructure.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except to the limited extent permitted by applicable law.
- Circumvent rate limits, daily quotas, age gates, geographic restrictions, or moderation enforcement.
- Operate more than one active account or evade a suspension or ban.
6. Enforcement
We may take any of the following actions when we determine that conduct violates these Terms or our Community Guidelines, with or without prior notice and at our sole discretion:
- Issuing a warning.
- Hiding, blurring, or removing the offending content.
- Restricting features (for example, suspending posting, calling, or messaging).
- Temporarily suspending the account.
- Permanently terminating the account, including without refund of unused coins or remaining subscription time where permitted by law.
- Reporting to law enforcement or NCMEC where legally required.
Our moderation team reviews reports of objectionable content and abusive behavior and acts on them — removing the content and/or ejecting the offending user — within 24 hours. The presence of content on Divine is not an endorsement, verification, or approval of that content.
7. Reporting
You can report a user, message, post, Story, Space, or Clan from inside the App. Every report goes to a human reviewer. We may follow up for additional information; you do not need to identify yourself to the reported user. Use support@divineapp.io for urgent reports that cannot wait, including imminent threats of harm.
8. Image moderation
Photos and Story uploads are scanned for harmful content (including nudity, sexual content, child sexual abuse material, violence, weapons, and known abusive imagery) before they reach other users. We use third-party moderation services for this purpose. If your upload is rejected, you will be told briefly why, and persistent attempts to circumvent moderation will result in account termination.
9. Intellectual property
9.1 Our intellectual property
The Divine name, logo, wordmark, visual design, trademarks, service marks, trade dress, sounds, and all other proprietary content, features, and technology associated with the Service are owned by Tiger LLC and are protected by United States and international intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent. Nothing in these Terms transfers ownership of any of it to you.
9.2 Copyright complaints (DMCA)
We respect the intellectual property rights of others. If you believe that content on Divine infringes your copyright, please send a notice compliant with the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent at support@divineapp.io with the subject line “DMCA Notice.” Your notice must include:
- A physical or electronic signature of the copyright owner or an authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information sufficient to permit us to locate it (a URL or in-app link is best).
- Your contact information (address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the owner.
We will process valid notices and may remove the material or terminate repeat infringers. Counter-notices are accepted at the same address. 10. In-app purchases and subscriptions
Divine offers paid subscriptions and consumable coin packs through the Apple App Store and Google Play Store. By making a purchase you agree that:
- All purchases are processed by the applicable app store and are subject to that store’s terms and refund rules.
- Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before the end of the current period through your app-store account settings.
- Prices may change. You will be notified of price changes before they take effect for your next billing cycle.
- You are responsible for all charges and applicable taxes.
- Coins are non-refundable except as required by applicable consumer-protection law.
- Tiger LLC does not sell physical goods through Divine.
11. Feedback
If you provide us with feedback, suggestions, ideas, or recommendations regarding Divine, you agree that we may use, modify, and incorporate that feedback without any obligation to you, that we own any features developed based on it, and that you are not entitled to compensation or attribution.
12. Third-party services
Divine integrates third-party services to make features work: real-time voice routing, image hosting, push notifications, crash reporting, analytics, age and identity verification, payments, and advertising. Those services are operated by independent companies under their own terms and privacy policies, summarized in our Privacy Policy. We are not responsible for the availability, accuracy, content, or practices of any third-party service, and your use of those services is at your own risk.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Tiger LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that results obtained will be accurate or reliable; that errors will be corrected; or that the Service will meet your specific requirements. We do not endorse, guarantee, or assume responsibility for any User Content, third-party content, or third-party services.
Divine is a communication platform, not a dating service. We do not conduct background checks on users and do not verify the statements users make in their profiles or during calls. You are responsible for your interactions with other users.
14. Limitation of liability
To the maximum extent permitted by law, in no event shall Tiger LLC, its directors, officers, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, any User Content or conduct of any third party on the Service, or any unauthorized access to or use of our servers and/or personal information.
In no event shall Tiger LLC’s aggregate liability for all claims relating to the Service exceed the greater of one hundred U.S. dollars ($100) or the amount you paid Tiger LLC, if any, in the twelve (12) months prior to the event giving rise to the liability. Some jurisdictions do not allow limitations of liability for certain damages, so some of these limitations may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless Tiger LLC and its directors, officers, employees, agents, affiliates, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of a third party (including intellectual property and privacy rights), or any User Content you submit.
16. Arbitration agreement, class action waiver, and dispute resolution
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH TIGER LLC AND LIMITS HOW YOU CAN SEEK RELIEF.
16.1 Informal resolution first
Before either of us files a claim, the party with the complaint agrees to send a written notice to the other describing the complaint and what relief is sought (the “Notice of Dispute”). Notices to Tiger LLC must be sent to support@divineapp.io with the subject line “Notice of Dispute” and must include your name, the email associated with your account, a description of the claim, and the relief sought. We will send our Notice of Dispute to the email on file for your account.
The parties will then attempt to resolve the dispute informally for at least sixty (60) days from delivery of the Notice. Only after that period may either party commence arbitration. Statutes of limitation are tolled during the informal-resolution period.
16.2 Binding arbitration
If informal resolution does not work, you and Tiger LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or our relationship with you (a “Dispute”) will be resolved through final and binding individual arbitration, rather than in court, with the following exceptions:
- Either party may bring an individual action in small-claims court for any Dispute within that court’s jurisdiction (typically claims under $10,000).
- Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual-property rights.
The arbitration will be administered by JAMS under its Streamlined Arbitration Rules (for claims under $250,000) or its Comprehensive Arbitration Rules (for larger claims), as amended by this Section, available at jamsadr.com/rules-streamlined-arbitration and jamsadr.com/rules-comprehensive-arbitration. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this arbitration agreement.
The arbitrator will have authority to decide all issues of arbitrability, including the scope, enforceability, validity, or formation of this arbitration agreement, except that a court of competent jurisdiction will decide whether the Class Action Waiver in Section 16.4 is enforceable.
16.3 Procedure
- Filing fees. If you initiate arbitration in good faith and your claim is for less than $10,000, Tiger LLC will pay the JAMS filing fee and the arbitrator’s fees and costs.
- Location. If your claim is for less than $25,000, the arbitration may be conducted via telephone, video conference, or written submissions only. For larger claims, the arbitration will take place in the U.S. county of your residence, unless we agree otherwise in writing.
- Discovery. Discovery will be limited as set out in the applicable JAMS rules.
- Decision. The arbitrator’s decision will be a written statement explaining the essential findings and conclusions and will be binding and enforceable in any court of competent jurisdiction.
- Confidentiality. The arbitration proceedings will be confidential, subject to applicable law.
16.4 Class Action Waiver
YOU AND TIGER LLC AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL PROCEEDING.
The arbitrator may not consolidate the claims of multiple persons and may award relief (including monetary, injunctive, and declaratory) only in favor of the individual party seeking relief and only to the extent necessary to provide relief for that party’s individual claim. If a court decides that any part of this Class Action Waiver is unenforceable as to a particular claim, that claim (and only that claim) will be severed from the arbitration and brought in court, and all other claims will continue in arbitration.
16.5 Jury Trial Waiver
IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND TIGER LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY.
16.6 30-day opt-out
You have the right to opt out of this Section 16 (Arbitration Agreement, Class Action Waiver, and Jury Trial Waiver) by sending written notice to support@divineapp.io with the subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Terms. The notice must include your name, the email associated with your account, and the date you accepted the Terms. If you opt out, Section 16 will not apply to you, but the rest of these Terms will. Opting out of arbitration does not affect any other agreement to arbitrate that you have with us.
16.7 Mass arbitration
If 25 or more claimants represented by the same or coordinated counsel submit Notices of Dispute raising substantially similar claims within a 60-day period, the parties agree that the JAMS Mass Arbitration Procedures and Guidelines will apply, including the staged-arbitration and bellwether processes described therein.
16.8 Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 16. Where a Dispute is not subject to arbitration (e.g., because of an exception above or a successful opt-out), any action or proceeding shall be brought exclusively in the state or federal courts located in California, and each party irrevocably consents to the personal jurisdiction and venue of those courts. Nothing in this section limits any non-waivable rights you may have under the consumer-protection laws of your country of residence.
17. Termination
You may delete your account at any time from within the App or by emailing support@divineapp.io. Deletion removes your profile and content from the Service within 30 days, subject to limited retention for legal, fraud-prevention, and moderation purposes described in our Privacy Policy.
We may terminate or suspend your access to the Service at any time, with or without notice or liability, for any breach of these Terms. The provisions of these Terms that by their nature should survive termination — ownership, warranty disclaimers, indemnification, limitations of liability, and dispute resolution — will survive.
18. Changes to these Terms
We may modify these Terms from time to time. If a change is material we will notify you in-App or by email before the change takes effect. Continuing to use Divine after the effective date of a change means you accept the revised Terms. If you do not agree, you must stop using the Service.
19. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be reformed to the minimum extent needed to make it enforceable while preserving the parties’ intent. These Terms, together with our Privacy Policy, Community Guidelines, Cookie Policy, Intellectual Property page, Child Safety policy, and Consumer Health Data Privacy Policy, constitute the entire agreement between you and Tiger LLC regarding Divine.
19A. Beta features
From time to time we may offer features described as “beta,” “preview,” “experimental,” or “early access.” Those features are provided as is, may contain bugs or incomplete functionality, may be modified or discontinued at any time without notice, and are offered only to a subset of users. Information about beta features may be confidential, and you agree not to publicly disclose them until we have launched them generally, unless we tell you otherwise.
19B. California consumer-protection notice
Under California Civil Code § 1789.3, California residents are entitled to the following consumer-rights notice: if you have a question or complaint regarding the Service, please contact us at support@divineapp.io. California residents may also reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
19C. Export and trade controls
The App is controlled and operated from the United States. You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. embargo or sanctions, and that you are not on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable U.S. and foreign export and re-export laws.
20. Apple-specific terms
If you downloaded Divine from the Apple App Store, you acknowledge that these Terms are between you and Tiger LLC only — not Apple — and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance and support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, which will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
